1. Acceptance

By accessing or using toppodesty (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

toppodesty provides Etsy market research tools including trending product data, shop analytics, and keyword research, primarily for print-on-demand (POD) and embroidery (EMB) sellers.

3. Acceptable use

You agree not to:

• Use the Service to harass, defame, or harm Etsy sellers or third parties.
• Attempt to reverse-engineer, scrape, or extract bulk data from the Service beyond what is provided via its UI or documented API.
• Use the Service for any illegal purpose or in violation of Etsy's Terms of Service.
• Submit false or fraudulent opt-out requests to delist competitors.

4. Sales estimate disclaimer

All sales figures displayed are estimateslabelled “Est.” They are derived from publicly available signals and do not represent actual Etsy transaction data. toppodesty makes no warranty, express or implied, regarding the accuracy, completeness, or fitness for purpose of any sales estimate. You use these estimates at your own risk.

5. Intellectual property

The toppodesty software, UI, and original content are the property of the toppodesty team. Shop and listing data is sourced from the official Etsy v3 API and remains the property of the respective shop owners and Etsy Inc.

6. Limitation of liability

To the fullest extent permitted by law, toppodesty shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Service, even if toppodesty has been advised of the possibility of such damages.

7. Opt-out rights for shop owners

Etsy shop owners may request removal of their shop data from the Service at any time by submitting the opt-out form. Requests are processed within 24 hours.

8. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of Ho Chi Minh City, Vietnam, or through binding arbitration at the parties' mutual agreement.
